Documentary about the plan by the Ontario government to permit sharia law. Sharia means "the path to the source of the water". It passed an act allowing religious groups to arbitrate family disputes, as a means of reducing the burden on its crowded courtrooms. Under a recent amendment the rulings of those arbitrators are now binding. In November 2003, a group of Ontario Muslims founded an organization called the Islamic Institute of Civil Justice, to offer arbitration of marriage, family and business disputes, based on the principle of sharia law. Subjects discussed include: discrimination against women in Muslim countries such as Nigeria, Pakistan and Saudi Arabia, based on sharia law; opposition by some Canadian Muslims to the application of sharia law in Ontario; fear that this will marginalize the ghettoize the Muslim community; opposition by women’s groups; concern that arbitration is a privatization of the law; concern that arbitration is not an open system like the courts; concern that sharia discriminates against women; would people lose protection under common law; the relationship of sharia law to the Charter of Rights and Freedoms; support for sharia in Ontario by Syed Mumtaz Ali, a retired Muslim lawyer and founder of the Islamic Institute for Civil Justice; domestic violence against women in the Muslim community; fear by some Muslim women that discrimination against women will get even worse if sharia is permitted; polygamy; the rights of Muslim women in scripture versus their actual rights in practice; a sharia will excluding non-Muslims from an estate and giving a son a larger share of the estate than do women in a family; and mainstream Canadian reaction to sharia law, which is characterized as anti-Muslim sentiment. Interviewees include: Tarek Fatah, the host of a public affairs program emphasizing Muslim affairs; Alia Hogben, the executive director of the Canadian Council of Muslim Women; and Syed Mumtaz Ali, who claims that he is denied his right to freedom of religion unless sharia law is applicable in Canada.
