Current affairs program about Canada's system of public access to legal counsel. The guests on the program are: Norman Borens, Q.C., of the York County Bar Association, and Professor Graham Parker, formerly of the Law Faculty of the University of British Columbia and now of Columbia University in New York. Borens recommends public support of legal aid as a community project funded by government grants. As society becomes more complex, the voluntary system is bound to disappear, according to Borens. He also recommends individual contributions in the form of a tariff of fees with a percentage paid to lawyers, with services to be performed by members of the legal profession at large, to encourage the practice of criminal law. Without such aid, the accused has three options: go to court without counsel; run the risk of bankruptcy through legal fees; or rely upon the charitable actions of the law association.~The guests criticize the present system because there are no investigation facilities, the necessary counsel is not always provided or is too late or incompetent, the needy do not know about the help that is available, there are too many exclusions, applications are lost in inefficient volunteer machinery, aid is refused without explanation, and indigent defendants make opportune guinea pigs for young lawyers.~Parker supports the use of public defenders but Borens feels that substituting such a quasi-corporate government office for individual independent counsel weakens the client's position and puts the prosecution and the defence under one system of government supervision.~Host Laurier LaPierre recommends careful amendments to the Criminal Code to make it mandatory that people be notified of their right to counsel and to be defended if they so wish. He also suggests putting some teeth in the Bill of Rights.
