Series consists of documents relating to the appeals process, both appeals to the Executive Council of Lower Canada and appeals to the King and Council of decisions of the Court of Appeal in Lower Canada. What distinguishes these records and justifies their inclusion within this fonds is the fact that they are the record of the appeal process for the cases involved. The cases had been heard before lower courts but were then heard in appeal before the Governor and Council, acting in the capacity of a Court of Appeal. The records do include copies of documentation previously submitted in lower courts, but the point is that such documents are found included among the records here by virtue of the fact that they were accumulated in the course of the Council's appeal hearing. Records are included which post-date the union of the Canadas. However, in each instance the original decision now under appeal was rendered during the Lower Canada period and so the records have been included in the present series and fonds.

Textual records (Papier) The CAB RG 4 Shelf List (see RG 4, B16 section) is a typed volume-level description which provides volume title and inclusive dates. The extent to which the ancient, idiosyncratic index to the S Series (ancestor to RG 4 and its series) may serve as a finding aid to these records has not yet been determined. That index must be used with caution, as there appear to have been no standards for the inclusion or exclusion of names, nor for filing by subject headings. CAB RG 4 Shelf List (90: Ouvert)

Note sur le classement :

Under the Record Group schema adopted at Library and Archives Canada in 1950, the records in this series had been included within RG 4 (Records of the Provincial and Civil Secretaries, Quebec, Lower Canada and Canada East), series B6. However, they have since , and for some time, been recognized as being properly records of the Executive Council of the Province of Lower Canada and not records of the Provincial and Civil Secretaries, documenting as they do the judicial functions of the Council. In the most recent intellectual re-arrangement, therefore, they have been brought together in the present series and fonds.
