The records document her employment for the Department of National Defence (DND), her grievances, the legal challenges, and her public speaking and public education and outreach.
The fonds also includes research, writings and educational material created by academics, activists, unions, women's organizations and government offices.Provenance:Biography/Administrative history:Robichaud, Bonnie, 1945- : Bonnie Robichaud (born 1945), a civilian employee with the Department of National Defense at North Bay, Ontario, filed grievances after her supervisor bullied, sexually harassed and sexually assaulted her.
Unsatisfied with the response to her grievances, she began what would become a multi-year legal challenge. She filed a complaint with the Canadian Human Rights Commission (CHRC) in 1980. This complaint was dismissed by the Canadian Human Rights Tribunal (CHRT) in July 1982.
In February 1983, the Canadian Human Rights Review Tribunal allowed an appeal on that decision and found both the employer and the harasser liable. The employer appealed the decision. In February 1985, the Federal Court of Appeal (FCA) set aside part of the 1983 decision. Later that year, Mrs. Robichaud and the CHRC appealed to the Supreme Court.
In July 1987, the Supreme Court of Canada (SCC) ruled unanimously that "the employer is responsible for the unauthorized discriminatory acts of its employees in the course of their employment."
In 1989, she was awarded financial compensation following a decision by the Canadian Human Rights Review Tribunal. In 1993, the FCA denied a request for further compensation.Additional information:General note:The legal process involved hearings by various courts and tribunals. Decisions were given by the Canadian Human Rights Tribunal (30 June 1982), the Canadian Human Rights Review Tribunal (14 February 1983), the Federal Court of Appeal (18 February 1985), the Supreme Court of Canada (29 July 1987), the Canadian Human Rights Review Tribunal (21 December 1989), and the Federal Court of Appeal (20 December 1993).
