Investissement Canada : La Loi sur Investissement Canada a été sanctionnée le 20 juin 1985 ch. 28, et est entrée en vigueur le 30 juin 1985 (TR/85-128). Investissement Canada a été créé en tant qu'organisme relevant du ministre responsable de la Loi sur Investissement Canada. La Loi stipule également que l'organisme est dirigé par un président ayant le statut d'administrateur général d'un ministère. Le 10 juillet 1985, [C.P. 1985-2049], le ministre de l'Expansion industrielle régionale a été désigné comme ministre compétent à l'égard de la Loi sur Investissement Canada.
La loi vise à encourager les investissements au Canada par des Canadiens et des non-Canadiens qui contribuent à la croissance de l'économie et à la création d'emplois ainsi qu'à instaurer l'examen des investissements importants effectués au Canada par des non-Canadiens afin de garantir ces avantages. Le mandat d'Investissement Canada inclut: encourager l'investissement de la façon qu'il juge indiquée; aider les entreprises canadiennes à tirer parti des possibilités d'investissement et du développement technologique; faire des études et des analyses sur l'investissement, tant au plan national qu'international; fournir des services, notamment d'information, en matière d'investissement afin de favoriser la croissance économique; aider à l'élaboration des politiques en matières industrielles et économique qui influencent l'investissement; et assurer que les avis et les examens d'investissement soient conformes.
Investissement Canada était composé de la Division de l'examen des investissements, la Division du secrétaire général, la Division du développement de l'investissement, la Division de la recherche et des politiques sur l'investissement, et la Division des services ministériels. La Division de l'examen des investissements exerçait surtout un rôle de réglementation. La Division du secrétaire général fournissait des conseils et des directives sur toutes les questions relatives à l'interprétation et à l'application de la Loi sur Investissement Canada, du règlement, des lignes de conduite, des termes et conditions et des notes explicatives. La Division du développement des investissements travaillait en étroite collaboration avec les provinces et les entreprises canadiennes pour exercer ses activités de promotion des investissements et offrir sa vaste gamme de services aux investisseurs. La Division de la recherche et des politiques sur l'investissement fournissait des renseignements à l'appui du programme de développement de l'investissement et du programme d'examen des investissements ainsi qu'à l'intention du Ministre sur des questions relatives à la politique sur l'investissement.
Le 23 février 1990 [C.P. 1990-387], le ministre de l'Industrie, des Sciences et de la Technologie a été désigné comme ministre compétent à l'égard de la Loi sur Investissement Canada.
En juin 1993, la réorganisation gouvernementale a regroupé Industrie, Sciences et Technologie, Consommation et Affaires commerciales, Communications Canada et Investissement Canada en un seul nouveau ministère : Industrie Canada. L'organisme Investissement Canada a été dissous en 1995 (ch. 1, art. 45) et les tâches prévues aux termes de la Loi ont été confiées aux responsables du Ministère actuel. Le 25 juin 1993 [C.P. 1993-1492] la responsabilité à l'égard de la Division du développement des investissements d'Investissement Canada a été transférée au ministère des Affaires extérieures.
Le 10 juin 1999 [C.P. 1999-1090], les tâches et les fonctions du ministre (parties II à VI de la Loi sur Investissement Canada) qui étaient liées au patrimoine culturel et à l'identité nationale du Canada (art. 15a) ont été confiées au ministre du Patrimoine canadien. Ce décret a été abrogé en 2009 (C.P. 2009-1614) en redonnant au ministre de l'Industrie la responsabilité de la partie IV. 1 de la Loi (Investissements portant atteinte à la sécurité nationale), tout en laissant au ministre du Patrimoine canadien les responsabilités énumérées dans le décret 1999-1090 concernant le patrimoine culturel et l'identité nationale.
