Canada. Land and Water Boards : In 1998, the Mackenzie Valley Resource Management Act (MVRMA) (Bill C-6) came into effect. The MVRMA provided for an integrated system of land and water management in the Mackenzie Valley and for the establishment of certain boards for that purpose. The Mackenzie Valley is defined by the area bounded in the north by the Inuvialuit Settlement Region, the east by Nunavut, in the west by the Yukon, and in the south by the NWT border, excluding Wood Buffalo National Park.
The MVRMA resulted from the Gwich'in Comprehensive Land Claim Agreement (1992) and from the Sahtu Dene and Metis Comprehensive Land Claim Agreement (1993). The regulatory regime in the Mackenzie Valley region entrenches the benefits and terms established by each of the Gwich'in, Sahtu, and Tlicho (2003) final agreements, through the MVRMA.
Pursuant to the MVRMA, the following four Land and Water Boards (LWB) were created: the Wek'èezhìi Land and Water Board, the Mackenzie Valley Land and Water Board, the Gwich'in Land and Water Board, and the Sahtu Land and Water Board. The co-managed LWB oversee the land and water management of their respective regions.
All LWB are governed by Boards consist of are composed of representatives of Tribal Councils, Territorial governments, and appointees by the Minister of Indian Affairs and Northern Development. It is the unique co-management nature of these LWB and regulatory authorities with powers over the use of land and waters that LAC wishes to document. The regulatory powers governing land and water use are given under certain treaties (cited above), and are intended to provide for an integrated and coordinated system of land and water management in the Mackenzie Valley. The co-management of resources between governments and Aboriginal groups in the Northwest Territories is unlike any other in Canada and came about as a direct result of the negotiation of comprehensive land claim agreements.
