After learning she would not receive PWA during maternity leave because she was eligible for unemployment insurance benefits, she filed a complaint with the Commission des droits de la personne et des droits de la jeunesse, rather than the he Commission des affaires sociales, claiming discrimination on the basis of sex and pregnancy, and cited the Charter of Rights and Freedoms. The Commission filed a motion to decline hearing her case, based upon its jurisdiction. (Ont.), the Appellant (BDO Capital, now New Solutions Financial Corporation), had a factoring agreement with Transport North American Express Inc. (the Respondent). The Appellant was to finance the Respondent's accounts receivable. A commitment letter provided for interest payments at 4% per month calculated daily, payable monthly in arrears. Later, a term loan agreement specified that New Solutions would buy $500,000 of Transport North American Express's account receivables with interest.
