Documentary about women who seek counselling for sexual assault and who are trying to stop defence lawyers from getting access to the counsellors’ records. Women in Windsor, Ontario are fighting to stop a defence lawyer from gaining access to the records of an alleged rape victim’s counselling sessions at the Windsor Crisis Centre. A women’s centre destroyed its records to stop lawyers from getting their hands on the records. Defence lawyers use the term “whacking the complainant” to describe tough cross-examination of the alleged victim at a preliminary hearing, using counselling records which often contain apparently contradictory personal statements, to make the woman more vulnerable at trial. A lawyer argues that the defendant has the right to a fair trial and that if the records are relevant and assist the defendant that they should be brought before the court. Others argue that women in counselling are traumatized and may be deny at first that there was an assault, statements that could be used by defence lawyers to discredit the women. <13mn 20s>
