Canada. Office of the Umpire : The Office of the Umpire was established under the 1940 Unemployment Insurance Act. This legislation introduced an appeals system which was outlined in Sections 46 to 66 of the Act. This system included three levels of appeal: the insurance agent, the Board of Referees and the Umpire Board. The Umpire Board was the third level of appeal whose decisions were final. Only the Federal and Supreme Courts could overturn the decisions rendered by the Umpire. Decisions of the Umpire therefore provided key cases for precedents in Unemployment Insurance matters and were typically used as tools to interpret the Act and the U.I. regulations.

The Office of the Umpire is comprised of a registrar and secretarial staff, who are mainly responsible for administering the operations of the Board. The Umpires who hear the cases are appointed by the Governor-in-Council. A Chief Umpire is appointed to direct the work of the Umpires. The Chief Umpire, with the approval of the Governor-in-Council, may appoint as many Umpires as he considers necessary. The Umpires under the original Act had to be Federal Court judges. The recent Act of 1980 expanded this criteria so that Umpires could include any judge of a superior county or district court in Canada. The Umpires operate independently from the Department, in order to insure impartial and legally binding decisions. The role of the Umpires is to preside over cases that have been overturned by the Board of Referees and to either reverse, uphold, modify, or return their decision to the Board. They are not bound by any legal or technical rules of evidence in conducting hearings.

Unlike the other two levels of appeal, the Office of the Umpire is a quasi-legal tribunal that operates at arms-length from the Department. The Office of the Umpire currently reports to the Minister of Human Resources Development. In the past it has been part of the Unemployment Insurance Commission, the Department of Manpower and Immigration and the Canadian Employment and Immigration Commission. The office of the Umpire Board is located in Ottawa, but Umpires can hear appeals at any place in Canada.
