Monckton. A.D.S. Answer to the French charge of a breach of the cartel. The Hospital being so near the battlefield, he could not but look on the wounded of the 13th who retired to it, as prisoners of war just as if they had been taken on the battlefield. He admits that the Hospital was not taken possession of, until the following night, but points out that it was equally in his power the night of the battle. For this reason he refused passports for the wounded of the 13th, but granted them for all who had been in the Hospital on the preceding day. As for the charge of sending home those who were not sufficiently recovered, even if this were true he was not to blame, as he sent none but such as the surgeons reported fit. But he declares with the greatest assurance that the greatest care was taken of the wounded and that none were embarked, but such as were to all appearance sufficiently recovered.

As he looked upon the wounded of the 13th as prisoners of war, it was necessary to place the Hospital under a guard of his own.
