Section 6000-6999, Travail : Le Programme du travail a pour mission de promouvoir l'équité, la santé, la sécurité et la coopération en milieu de travail, au profit du bien-être économique et social de tous les Canadiens et Canadiennes. Leur rôle est de permettre aux Canadiens et aux Canadiennes d'acquérir les habiletés nécessaires pour répondre aux changements qui touchent le milieu du travail afin de les aider à s'adapter à l'évolution de la nature même du travail. Nous sommes responsables de l'application du Code canadien du travail, de la Loi sur l'équité en matière d'emploi et d'autres lois régissant les salaires et les conditions de travail.
Ils veillent à faire respecter les dispositions du Code canadien du travail concernant la santé et la sécurité au travail ainsi que les normes du travail. La Direction veille en outre à l'application de la Loi sur l'équité en matière d'emploi, de la Loi sur les justes salaires et les heures de travail, de la Loi sur l'indemnisation des agents de l'État et de la Loi sur l'indemnisation des marins marchands. Elle gère également, au nom du Conseil du Trésor, l'exécution du Programme de contrats fédéraux et la prestation des Services de prévention des incendies.
Aperçu historique, le Programme du travail:
Presque tout au long du siècle précédent, le Programme du travail était un ministère fédéral indépendant. Créé en vertu de l'Acte de conciliation, de 1900, le ministère du Travail rassemble et diffuse diverses statistiques du travail par l'intermédiaire de sa publication de prestige, la Gazette du travail. En outre, le Ministère aide les travailleurs, les syndicats et les employeurs à régler les conflits de travail en plus de veiller à ce que les travailleurs obtiennent un juste salaire et de meilleures conditions de travail sur les chantiers de travaux publics.
Dès les années 40, le ministère du Travail influe sur la vie de milliers de Canadiens dans le cadre de programmes fédéraux-provinciaux à frais partagés, qui sont axés sur la prestation de services d'emploi, l'enseignement technique, le versement de pensions de vieillesse et l'assistance-chômage. De plus, le Ministère participe à des enquêtes sur les coalitions, à l'enseignement professionnel, aux programmes de rentes sur l'État et à l'établissement des lois sur les justes salaires relativement aux projets fédéraux en matière de travaux publics. En 1940, le Ministère devient responsable de la Commission d'assurance-chômage du Canada, qui est établie depuis peu.
Au cours de la Deuxième Guerre mondiale, le ministère du Travail est chargé de gérer les ressources en main-d'oeuvre civile de manière à combler les besoins militaires et à satisfaire aux exigences des services essentiels. En 1966, le gouvernement crée le ministère de la Main-d'oeuvre et de l'Immigration et lui confie la planification de la main-d'oeuvre, les services d'emploi ainsi que la Commission de l'assurance-chômage qui relevaient auparavant du ministère du Travail.
Le ministère du Travail met tout en oeuvre pour s'adapter au système social du Canada qui évolue sans cesse et ce, en continuant de veiller à l'application du Code canadien du travail (partie 1 : Relations du travail ; partie II : Sécurité et santé au travail ; et partie III : Normes du travail) et de la Loi sur les justes salaires et les heures de travail. Au fil des ans, le ministre du Travail devient responsable de l'application d'un grand nombre d'autres lois et règlements, y compris les suivants : Loi sur l'équité en matière d'emploi, Loi sur la santé des non-fumeurs, Loi sur l'indemnisation des agents de l'État, Loi sur l'indemnisation des marins marchands, Règlement sur l'indemnisation des détenus de pénitenciers, et Loi sur le statut de l'artiste.
Le Ministère intervient dans un grand nombre de secteurs importants au fil des ans. Le gouvernement crée le Bureau de la main-d'oeuvre féminine en 1954 pour aborder les questions concernant les femmes. Sur la scène internationale, le Ministère participe depuis longtemps aux activités de l'Organisation internationale du Travail. Dans les années 90, à la suite de la signature de l'Accord nord-américain de coopération dans le domaine du travail et de l'Accord canado-chilien de coopération dans le domaine du travail, le Programme du travail élargit les démarches qu'il effectue à l'échelon international pour assurer le bien-être des travailleurs. En 1998, le ministre du Travail assiste à la Conférence interaméricaine des ministres du Travail ; c'est la première fois qu'un ministre du Travail du Canada assiste à cette conférence.
Certains programmes et leur développement :
- Services de prévention des incendies
Ce programme s'adresse à trois principaux groupes de clients : la fonction publique fédérale, les Premières nations et les sociétés d'État. Il leur offre des services différents et applique des politiques de conformité.
Fonction publique fédérale
Les responsables du programme sont chargés d'appliquer et de contrôler l'application des politiques et des normes de prévention des incendies pour protéger les biens réels et personnels gérés par les ministères et les organismes fédéraux autres que le ministère de la Défense nationale. Les principales activités de conformité sont les suivantes : Inspection de prévention des incendies, Examen et approbation des plans et devis pour la protection contre les incendies, Examen des plans de sécurité-incendie et rapports sur les incendies.
Premières nations
Le programme prévoit des inspections de prévention et l'examen des plans et devis des immeubles publics et des écoles des réserves des Premières nations, pour aider les bandes à remplir leurs obligations en matière de sécurité publique.
Sociétés d'État
Le programme prévoit l'examen des plans et devis et des études techniques pour certaines sociétés d'état qui ont signé des ententes et qui paient pour ce genre de services. Il s'agit de sociétés qui ne sont plus assujetties à la politique du Conseil du Trésor sur la gestion des risques d'incendie, mais qui ont encore besoin de conseils professionnels pour gérer ces risques.

- Direction de l'information sur les milieux du travail
L'équipe de l'Information sur les milieux de travail est la source de renseignements à jour et personnalisés sur les relations industrielles et la négociation collective. Ils aident les travailleurs et les employeurs à se préparer en vue de contribuer au règlement de questions à la table de négociation. Ils peuvent également les tenir au courant des innovations dans le domaine des relations du travail, grâce à leur service d'information et à leurs publications. C'est la raison pour laquelle négociateurs, chercheurs, économistes, consultants, journalistes, professeurs, et nombre d'autres spécialistes font appel à leurs ressources. En fait, au Canada comme à l'étranger, les intervenants dans le domaine des relations industrielles, dans les secteurs public et privé, ont régulièrement recours aux services de la Direction de l'information sur les milieux de travail.
- Programme de prestations d'adaptation pour les travailleurs
Le programme de prestations d'adaptation pour les travailleurs que Travail Canada administre conjointement avec Emploi et Immigration Canada assure le maintien d'un revenu de dernier ressort aux travailleurs âgés admissibles qui ont été mis à pieds de façon permanente dans des secteurs d'activité désignés. Ces derniers sont des secteurs que le gouvernement fédéral a désigné comme connaissant d'importantes perturbations ou transformations économiques qui entraînent une diminution des emplois, soit à l'échelle nationale, régionale ou communautaire. La Loi sur les prestations d'adaptation pour les travailleurs a été modifiée en novembre 1983 afin d'accroître l'admissibilité aux prestations prévues par la loi.

- Équité en milieu de travail
Ce programme comprend les trois principaux éléments suivants :
a) Programme légiféré d'équité en matière d'emploi
Ce programme de réglementation est basé sur la Loi sur l'équité en matière d'emploi. Cette loi vise à corriger les conditions d'emploi défavorables aux femmes, aux Autochtones, aux personnes handicapées et aux membres des minorités visibles, afin de rendre la main-d'oeuvre plus représentative. Elle prévoit des mesures spéciales et des mesures d'adaptation aux différences, nécessaires pour assurer l'égalité d'accès aux occasions d'emploi et aux avantages liés à l'emploi. Elle s'applique aux entreprises de compétence fédérale, aux sociétés d'état ayant 100 employés ou plus, et à certains éléments de la fonction publique fédérale. La Loi sur l'équité en matière d'emploi confie à la Commission canadienne des droits de la personne la responsabilité de vérifier les entreprises des secteurs privé et public et la fonction publique fédérale et de remettre une instruction aux employeurs non conformes. Si l'employeur ne suite pas une instruction ou conteste les conclusions de la Commission, son cas peut être soumis au Tribunal de l'équité en matière d'emploi.
b) Programme de contrats fédéraux
Ce programme est mentionné dans la Loi sur l'équité en matière d'emploi et il est expliqué en détail dans une norme du Conseil du Trésor publiée dans la circulaire n. 1986-44 du Conseil du Trésor. Son objectif est le même que celui du Programme d'équité en matière d'emploi susmentionné. Il s'applique aux entreprises de compétence provinciale de 100 employés ou plus qui obtiennent des contrats de 200 000 dollars ou plus pour la fourniture de biens et de services au gouvernement fédéral.
c) Équité salariale
Ce programme a été mis sur pied en vertu de l'article 182 de la partie III du Code canadien du travail et de l'article 11 de la Loi canadienne sur les droits de la personne, pour que les hommes et les femmes employés dans le même établissement puissent recevoir un salaire égal pour un travail d'égale valeur. Il s'applique aux employeurs de compétence fédérale, quelle que soit leur taille.

- Santé et sécurité au travail
Ce programme de réglementation est basé sur la partie II du Code canadien du travail, qui vise à « prévenir les accidents et les maladies liés à l'occupation d'un emploi régi par ses dispositions », dans les industries de compétence fédérale et la fonction publique fédérale. En plus des agents de Développement des ressources humaines Canada, des agents de Transports Canada et de l'Office national de l'énergie sont nommés par le ministre du Travail pour agir en tant qu'agents de santé et de sécurité en vertu de la partie II du Code.
Pour favoriser l'exercice de la responsabilité interne par les parties en milieu de travail, la partie II du Code prescrit l'établissement de comités de santé et de sécurité, dans les lieux de travail comptant au moins 20 employés ou la nomination d'un représentant en matière de santé et de sécurité, lorsqu'il y a entre cinq et dix-neuf employés dans le lieu de travail, ou que certaines conditions sont réunies ; elle exige aussi que l'employeur dont l'effectif compte 300 employés ou plus établisse un comité d'orientation en matière de santé et de sécurité, en plus du comité local de santé et de sécurité.
Les comités d'orientation, les comités locaux de santé et de sécurité ainsi que les représentants en matière de santé et de sécurité ont un certain nombre de pouvoirs communs, afin d'inciter les employeurs et les employés à travailler ensemble pour cerner les problèmes de santé et de sécurité au travail et leur trouver des solutions.

- Secrétariat de la planification, Centre d'hygiène et de sécurité au travail
Le premier Centre d'hygiène et de sécurité au travail au Canada a été créé par l'adoption du Bill C-35, par la Chambre des communes, le 17 avril et par le Sénat le 20 avril. Il a reçu la Sanction royale (1978).
Le projet de loi autorise l'établissement du Centre canadien d'hygiène et de sécurité au travail, un organisme autonome et indépendant dont le mandat est de promouvoir le droit fondamental qu'ont tous les Canadiens de travailler dans un milieu sain et sûr. Il relevera du Parlement par l'intermédiaire d'un ministre, mais ne fera partie d'aucun ministère ou organisme du gouvernement.
Le Centre sera régi par un Conseil de 39 membres... Le Conseil, qui se réunira au moins 3 fois par année, formera aussi des comités consultatifs pour les seconder dans son travail.
Certaines des fonctions principales du Centre consisteront à établir un régime intégré d'information sur tous les aspects de l'hygiène et de la sécurité au travail, à disséminer des renseignements fiables auprès des Canadiens et à stimuler la recherche. Le Centre n'aura aucun pouvoir de réglementation.
La loi exige que le Centre publie les rapports sur les recherches ou sur les études auxquelles il donne son appui dans les 90 jours qui suivent la réception de ces rapports. Les renseignements seront publiés avec ou sans l'accord de tous les groupes, sans attendre l'approbation du gouvernement. La loi exige aussi que le Centre étudie les mémoires et les représentations des groupes de particuliers intéressés et qu'il justifie les mesures qu'il prendra et les réactions qu'il aura a cet égard et ce, chaque année.
- Les normes du travail

La partie III du Code canadien du travail (normes du travail) et le règlement connexe s'appliquent aux employeurs et aux employés qui travaillent dans des installations, des ouvrages, des entreprises ou des secteurs d'activité relevant de l'autorité législative du Parlement du Canada.
De façon générale, les activités qui relèvent de la compétence fédérale sont les suivantes :
- Les services provinciaux et internationaux, dont :
- les chemins de fer ;
- le transport routier ;
- les réseaux de téléphone, de télégraphe et de câble ;
- les pipelines ;
- les canaux ;
- les transbordeurs, les tunnels et les ponts ;
- le transport maritime et les services connexes ;
- la radiodiffusion et la télédiffusion, y compris la câblodistribution ;
- le transport aérien, les aéronefs et les aéroports ;
- les banques ;
- les entreprises visant à protéger et à préserver la pêche en tant que ressource naturelle ;
- les activités et les communautés des Premières nations ;
- certaines entreprises que le Parlement a déclarées d'intérêt national, dont :
- la plupart des silos à céréales ;
- les meuneries, moulins, entrepôts de provendes et les usines de nettoyage des semences ;
- les entreprises d'extraction et de transformation de l'uranium ainsi que de l'énergie atomique
La plupart des sociétés d'État - la Société canadienne d'hypothèques et de logement et la Société canadienne des postes, par exemple - sont assujetties à la partie III du Code, qui ne s'applique toutefois pas aux employés de la fonction publique fédérale.
Les normes
Le but principal de la partie III du Code canadien du travail est d'établir et de protéger le droit des divers intervenants en milieu de travail à des conditions de travail justes et équitables.
Le Code n'établit que des normes minimales, qui ne doivent en aucun cas faire obstacle à des droits ou avantages plus favorables accordés en vertu d'une convention collective, d'une entente privée ou d'une politique de l'employeur. En outre, les entreprises syndiquées ne sont pas assujetties aux sections du Code portant sur le salaire minimum, sur les congés annuels, sur les jours fériés et sur les congés de décès si leur convention collective prévoit des droits ou avantages au moins aussi favorables que ceux qu'accorde le Code en ce qui a trait à la durée des congés, au taux de salaire et à la période de travail ouvrant droit à ces avantages, et si elle comporte une disposition qui permet le règlement des différends par un tiers.
Durée de travail : La durée normale du travail est de huit heure par jour et de 40 heures par semaine. Toutes les heures supplémentaires doivent être rémunérées au moins au taux normal majoré de moitié. La durée hebdomadaire maximale du travail s'établit à 48 heures. Il est néanmoins possible, grâce à certaines dispositions, de faire preuve de plus de souplesse dans l'application de ces normes.
Salaire minimum : Le taux de salaire minimum applicable aux employés relevant de la compétence fédérale est le même taux courant établi pour les adultes par chaque province et territoire, tel qu'il est modifié de temps à autre. Chaque fois qu'une province ou qu'un territoire rajuste son taux de salaire minimum, le taux de salaire minimum dans les secteurs de compétence fédérale est automatiquement rajusté dans cette province ou ce territoire.
Les congés annuels : Tous les employés ont droit à un congé annuel d'au moins deux semaines, avec une indemnité de congé annuel correspondant à quatre pour cent au moins de leurs gains annuels bruts. Les employés qui ont travaillé sans interruption pour le même employeur pendant six années consécutives ont, pour leur part, droit à un congé annuel d'au moins trois semaines, avec une indemnité minimale correspondant à six pour cent de leurs gains annuels bruts. L'employeur doit accorder ce congé annuel à l'employé au plus tard 10 mois après la fin de l'année lui donnant droit au congé. Les jours de congé annuel auxquels l'employé a encore droit au moment de quitter son emploi doivent lui être payés.
Les jours fériés : Les employés ont droit à neuf jours fériés par année. La substitution de jours fériés est autorisée lorsqu'il en est fait mention dans la convention collective, ou lorsque l'employeur et 70 pour cent des employés concernés conviennent d'une telle substitution.
La réaffectation et le congé liés à la maternité, le congé de maternité et le congé parental : L'employée qui est enceinte ou qui allaite un enfant peut, dans la mesure ou cela s'avère raisonnable et pratiquement réalisable, demander à son employeur de modifier temporairement ses fonctions ou de l'affecter à un autre poste si le fait de continuer à remplir de telles fonctions présente un risque pour sa propre santé, ou pour celle du foetus ou de l'enfant. Cette demande doit toutefois être accompagnée d'un certificat, établi par un médecin qualifié, dans lequel ce dernier aura pris soin de préciser la durée prévue du risque possible, de même que les activités ou conditions à éviter. Par ailleurs, l'employeur ne peut pas congédier, suspendre, mettre à pieds ou rétrograder une employée, ni prendre des mesures disciplinaires contre elle, sous prétexte qu'elle est enceinte ou qu'elle a l'intention de prendre un congé de maternité ou un congé parental. L'employeur ne peut pas non plus invoquer le fait que l'employée est enceinte ou qu'elle a l'intention de prendre un congé de maternité ou un congé parental pour lui refuser de l'avancement ou de la formation. L'employé en congé a le droit, s'il en fait la demande par écrit, d'être tenu informé de toutes les possibilités d'emploi, d'avancement et de formation qui se présentent et qui correspondent à ses qualifications professionnelles. Le Code prévoit également que les droits d'ancienneté continuent de s'accumuler et que les régimes de prestations de retraite, de maladie et d'invalidité demeurent en vigueur pendant la période de congé, à la condition que l'employé verse, dans un délai raisonnable, les cotisations qu'il aurait normalement payées. L'employeur doit, pour sa part, continuer à verser des cotisations au moins égales à celles qu'il paierait si l'employé n'était pas en c678
