For the information of officials in Upper Canada, copies were made of the proceedings in the trial Regina v. Finlay Malcolm et al. at the Court of Queen's Bench in London, 12-23 January 1839 when questions regarding the legality of the Niagara District treason trials and transportation of the 23 men were addressed. These contemporary copies, made from the shorthand notes of a Mr. Gurney, form volume 1; a set of transcripts forms volume 2.

Finlay Malcolm and twenty two others whose sentence had been commuted to transportation were shipped in November 1838 on the CAPTAIN ROSS to England. Following the proceedings in Queen's Bench, Finlay Malcolm and nine others were released on condition that they never return to Upper Canada. The remaining thirteen were held briefly on the hulk YORK at Portsmouth before being sent on to Van Diemen's Land, nine on the MARQUIS OF HASTINGS in March 1839 and four in September 1839 on the CANTON.
