Fonds consists of the papers of John Cary [d. 1720], relating to the objections of the Bristol merchants to the payment of import duties on fish and oil from Newfoundland (transcripts, 6 pages). They consist of: 1. A letter of protest on behalf of the Bristol merchants written by John Cary, 21 February 1695, to the Commissioners of Customs (f. 23). 2. A legal opinion, signed Waterson (f. 23). 3. Extract from an Act of Parliament, 25 Car. II (ff. 23-23v). 4. The case on this statute in respect to the merchants of Bristol, with the opinion of the Attorney General, Thomas Trevor (1658-1730), regarding Cary's query concerning what proof was required as to the origin of the fish and oil (ff. 23v-24). 5. A method of proof suggested to the Commissioners of Customs by Cary (f. 24). 6. Letter, 11 March 1695, from Cary to the Commissioners of Customs (f. 24v). 7. Extract from an Act of Parliament, 5 Eliz. cap. 5 (f. 24v). 8. The case on this statute in respect to the merchants of Bristol stated by John Cary (f. 25). 9. The state of the case put by the Solicitor to Customs, John Bridges (1666-1724), with the opinion of Attorney General Trevor (f. 25). 10. Letter from the Board of Customs, 30 April 1696, to John Dutton Colt, the Collector of Customs in Bristol (f. 25v).

Cary, John, died 1720? : Merchant and writer on trade.

John Cary [d. 1720] was the son of Thomas Cary, vicar of St. Philip and St. Jacob, Bristol. Engaged in the West Indies sugar trade, he was led to take a political interest in commercial matters. He was warden of the Merchant Venturers' Company at Bristol in 1683-1684. When the mayor and council of Bristol were removed, January 1688, on account of their opposition to the penal laws, Cary was placed on the substituted council, from which he was removed in October 1688. He acted as an arbitrator in commercial disputes, and was chosen by the Bristol committee of trade as their representative in London to advise the city members in matters affecting Bristol trade. An essay on trade that he published in 1695 attracted attention and brought him into correspondence with John Locke, who commended it highly, and he wrote a considerable number of other works on various commercial and economic subjects.

Additional Manuscripts 5540 was transferred in 1796 to the Manuscript Department of the British Museum (now the British Library) by the Museum's Library of Printed Books. It is a thin volume of 123 folios, containing miscellaneous letters and papers that formerly belonged to the prominent Bristol merchant, John Cary [d. 1720]. The list of contents that prefaces the volume indicates that it once contained many more papers than it does now. In 1915, the National Archives of Canada transcribed a small excerpt (No. 10, ff. 23-25v) that was of Canadian interest.
