These certified contemporary copies of Ordinances and Acts passed in Nova Scotia, 1749-1753 and 1770-1782 (volumes 3-5), and of the Journals for the Legislative Council, 1768-1779, 1781 (volumes 1-2) were identified as duplicates and segregated from the principal series at the Public Record Office. Annotations on the texts record some of those relationships and the treatment accorded these records

Nova Scotia. Legislature : Prior to the establishment of parliamentary institutions in the colony of Nova Scotia, the governor provided necessary regulations unilaterally through proclamations or in consultation with his Council through Ordinances. Establishment of a bicameral legislature, formed of an elective House of Assembly and an appointive Legislative Council, in 1758 enabled Nova Scotians to participate in the passage of laws governing their lives.

The manuscript journals compiled as a summary record of the deliberations in each chamber of the Legislature were copied for transmission in duplicate to the imperial authorities, while the originals were retained in the colony [and are now found in the provincial archives]. The journals were printed for the information of the populace at large.

Similarly, certified duplicates of all Ordinances passed by the governor and his Council before 1758, and of all Acts passed by the legislature thereafter, were sent to the imperial authorities while originals were retained in the colony. These statutes were printed in the official gazette [after 1752] and in compilations for public distribution. The governor commented on legislative activities in his covering despatches to London (see MG 11, CO 217), while the Law Officers in England gave their opinions on the validity of colonial statutes (see MG 11, CO 323, volumes 34-91).

General note:

Ordinances passed before September 1752, when the Gregorian calendar was adopted in the British Empire, may be dated in the style "24 February 1749/50" if passed in the first three months of a year. Such dates should be interpreted by noting the later year. Ordinances of Cape Breton, also received from the PRO, were transferred from volume 6 to MG 9, B 11 before 1969.

Printed editions of both the Journals and the Acts are available on microfilm through the National Library of Canada. The manuscript statutes for 1749-1819 in Colonial Office 219 are available on microfilm (see MG 11, CO 219). Copying from the microforms is permitted.
