Collection consists of copies and drafts of papers, 1720-1724, relating to Governor Shute's memorial. They include correspondence between the Lords Justices, the Council of Trade and Plantations, and the law officers of the Crown, together with extracts from the printed Votes of the Massachusetts Bay House of Representatives. The collection concludes with a draft of the report from the Attorney General and Solicitor General to the King, 31 October 1724, with Shute's marginal notes and corrections. Transcripts, 78 pages.

Shute, Samuel, 1662-1742 : Colonial Governor of Massachusetts.

Colonel Samuel Shute (1662-1742) was born 12 January 1662. He was the son of Benjamin Shute of London, England, and his wife, a daughter of the Reverend Joseph Caryl, a nonconformist minister. He obtained a captaincy in the army, fought in Marlborough's campaigns, and was wounded at Blenheim. In 1712, he became lieutenant-colonel of the 3rd Dragoon Guards.

In April 1716, he was selected for the governorship of Massachusetts Bay and New Hampshire. His constant disputes with the colony's House of Representatives anticipated the storm that broke half a century later. In 1723, despairing of conducting the government in the face of the Assembly's extraordinary claims to authority, he returned to England to lay his administrative difficulties before the advisers to the Crown.

He prepared a memorial to the King in which he charged the House of Representatives with encroaching upon the royal prerogative, as well as with refusing to make proper provision for the salaries of the governor and lieutenant-governor (see C.O. 5, vol. 868, ff. 382-384v, 385v, and vol. 915, pp. 365-377, in Calendar of State Papers, America and West Indies, 1723, No. 683). The Council of Trade and the law officers of the Crown upheld Shute's charges for the most part, but his commission was vacated by the death of George I and he never returned to Massachusetts Bay. He died on 15 April 1742.
