Colonial Office 45 is a specific class of "Sessional Papers" bringing together the Minutes of the Executive (or Privy) Council and Journals of the House of Assembly and Legislative Council for each colony. It includes these records for Quebec, Upper and Lower Canada and the Province of Canada, plus the proceedings of the Special Council of Lower Canada. The transcripts preserved here are limited to the Minutes of the Land Committee for the Executive Council of Upper Canada, January-December 1809 (vol. 135), and the Journal of the Legislative Council for Upper Canada, February-March 1810 (vol. 138). The transcripts are available on microfilm reel C-13615.

General note:

The original minute books in RG 1, E 1 and L 1 are the most complete and reliable texts, notably for legal purposes. The printed Journals are likewise to be preferred.

Each colonial governor was required to forward copies of the minutes of his Council and the Journals of the legislature to the imperial authorities on a regular basis. Initially, these copies were filed with their covering despatch in the principal series of correspondence for the colony in question. As legislative business increased and the Journals came to be published, filing practice changed in London: bound volumes were segregated from the despatches., Printing of the Journals for both houses of the legislature resulted in wide distribution and fair survival of these records. The original State and Land Minute Books of the Executive Council have survived (see RG 1, series E 1 and L 1), as have some of the manuscript Journals of the legislatures (see RG 14, series A 2, A 3 and B 1). Furthermore, during the reorganization of 1908-1910, the Public Record Office had transferred certain duplicate journals and minute books to the Public Archives of Canada, while contemporary copies or later transcripts had been received from other sources [see MG 40 A 1]. Therefore, no further copying in CO 45 has been undertaken., When the Public Archives of Canada began copying the Colonial Office records relating to Quebec and the Canadas in the 1890s, the Minutes of the Executive Council and the Journals of the House of Assembly and the Legislative Council were scattered through several series for each colony. The transcripts were arranged in series for Quebec, Lower Canada and Upper Canada and designated volumes M 234 to M 306 in the M Series. On creation of MG 11 in 1950, all the transcripts except the volumes corresponding to CO 45/135 and 138 were withdrawn from circulation., The transcripts were microfilmed in 1979.
